On April 16, 2026, the U.S. International Trade Commission (ITC) issued an announcement regarding a partial final determination in the Section 337 investigation of Certain Women's Flats with Colored Outsoles (Investigation No. 337-TA-1428). On September 8, 2025, the ITC issued a final determination, ordering a review of the initial determination (No. 10) issued by the presiding Administrative Law Judge (ALJ) on July 23, 2025. The original ALJ ruling found that China-based respondents Pierjeda Information Technology Co., Ltd. (Guangzhou), Bingxin Qingfeng (Guangdong), and tb249835650 (Guangdong) infringed patents D681,928, D844,951, D681,927, D686,812, and D688,853, and that the complainant had established a domestic industry in the United States. The ALJ presumed the asserted patents valid as they were not challenged. The ALJ recommended issuing a general exclusion order covering products infringing D681,928, D844,951, D681,927, D686,812, and D688,853, and imposing a 100% bond on infringing imports during the presidential review period. The ITC's review focused on whether the complainant satisfied the economic prong of the domestic industry requirement, declined to review the remainder of the initial determination, and sought public interest comments regarding potential remedies. Written submissions were due no later than September 22, 2025.
On June 4, 2025, the ITC issued a final determination declining to review the initial determination (No. 7) issued by the ALJ on May 5, 2025, thereby finding all named respondents in default.
On December 13, 2024, the ITC voted to institute a Section 337 investigation of Certain Women's Flats with Colored Outsoles (Investigation No. 337-TA-1428).
On November 13, 2024, Gavrieli Brands LLC of Culver City, California, filed a Section 337 complaint with the ITC, alleging that the products, when exported to, imported into, or sold within the United States, violated Section 337 (infringement of U.S. design patents D681,928, D844,950, D844,951, D681,927, D781,035, D781,032, D686,812, and D688,853). The complainant requested that the ITC issue a general or limited exclusion order and cease and desist orders.
